Election Inspectors
After July 1 , 2006 California law (Civil Code 1363.03) requires the board of directors to appoint independent third party “election inspectors” to conduct and oversee the;

• Election of directors
• Voting on amendments to the governing documents
• Voting on assessments (when the change is outside the board’s authority)
• Voting to grant exclusive use of common area

The election inspector is required to do all the following;

• Determine the number of memberships entitled to vote and the voting power of each
• Determine the authenticity, validity, and effect of proxies, if any.
• Receive ballots
• Hear and determine all challenges and questions in any way arising out of or in connection with the right to vote
• Count and tabulate all votes
• Determine when polls shall close
• Determine the result of the election
• Perform any acts as may be proper to conduct the election with fairness to all members

The law also prescribes how the ballots are to be mailed, the type of envelopes to be used and the requirement that the ballots be counted in an open meeting.
