Management
Traditionally, developers have hired management companies to set-up and manage the Homeowners Association while the developer controls the Board of Directors. Unfortunately, in this role, the management company's legal fiduciary duty is to the Homeowners Association, not to the developer. Bicksler and Associates serves the interests of the developer on the Board of Directors, and in the turnover and acceptance process.

Most Homeowner Association managers have two to three years experience in the field, and little or no specific training. Frequently, your project rests in this persons hands.

Who on the developer's staff really knows what the management company is supposed to be doing? A University of California research report, which we participated in developing, revealed that one third of all the California developers of common interest subdivisions are sued by the very Homeowners Association's they have created.
