A Homeowners Association is a unique combination of a quasi-government and mutual benefit corporation. It must be viewed as an integral part of the product that is being created and marketed.

The Homeowners Association first takes shape in the projects' early designing stages usually because of the relationship of buildings to land. This relationship will dictate the legal form the Association will take such as, condominium, townhouse, mixed use or master planned community. How does this form match the buyer target market? How will this form translate into a monthly assessment? What kinds of product and marketing options do each of the forms provide?

Attorneys are asked to create a Homeowners Association through the preparation of legal documentation known as Articles of Incorporation, Covenants, Conditions, and Restrictions, and By-Laws. However, few attorneys have direct management experience with the entity they have been asked to create. An unanticipated nuance related to parking, architectural controls, pets, maintenance, or insurance can cost enormous amounts of the developer's time and effort in the later stages of the project.
